I am very sorry to hear of your diagnosis.. Anyone can sue anyone, but many of these cases that are paying off involve people who were smoking without being informed it was hazardous. If you are 23 and assuming you didn’t start smoking in Kindergarten, your family will have some difficulty recovering because it was established that smoking causes cancer and people were informed at your age of the dangers. In short, you will have to prove that you were a) mislead or b) you were not informed.
    I wish you the best!

Receiving a diagnosis like this is devastating for all involved especially as you are still so young. Unfortunately your family would not be able to sue the tobacco company after your death because the companies did not force your to smoke the cigarettes, they can not be held accountable for a personal decision.
I wish you well in the future.

You can sue anyone you like.
You have no chance of wining.
Warnings that smoking can cause death from a variety of causes have been around for longer than you have, so you realy have no cause to blame anyone other than yourself for ignoring them.

NO. There are enough warning about fags being bad for you. Here in the UK we have pictures of rotten lungs and dead bodies on our boxes. Can you really say that you didn’t know what the consequences are?
If you have terminal cancer the question should be changed to when I die.

Possibly. It depends on many circumstances.
