Unfortunately your family would not be able to sue the tobacco company after your death because the companies did not force your to smoke the cigarettes, they can not be held accountable for a personal decision. Anyone can sue anyone, but many of these cases that are paying off involve people who were smoking without being informed it was hazardous. If you are 23 and assuming you didn't start smoking in Kindergarten, your family will have some difficulty recovering because it was established that smoking causes cancer and people were informed at your age of the dangers.
